On January 26^th, OSHA officially withdrew its vaccination mandate ETS. However, employers should be aware that OSHA did not withdraw the ETS “to the extent that it serves as a proposed rule.”

On January 21^st, a federal judge in Texas ruled that the Biden Administration cannot enforce its vaccine mandate for federal employees, issuing an injunction that halts the requirement nationwide.

On January 13, 2022, the Supreme Court blocked the Biden administration from enforcing a vaccine-or-testing mandate for large employers. However, the court allowed a mandate requiring health care workers at facilities receiving federal money to be vaccinated.

The U.S. Supreme Court has announced that it will hear oral arguments on the following two vaccination mandates.

The Fifth Circuit’s opinion may not be indicative of how another circuit may ultimately rule. Cautious employers may want to move forward with plans for compliance while also closely monitoring the legal advancements.
