Federal Court Vacates 2024 Title IX Regulations

On Thursday, January 9, 2025 a federal judge out of the United States District Court for the Eastern District of Kentucky struck down the 2024 Title IX Regulations.

The 2024 Title IX Regulations, which had previously gone into effect on August 1, 2024, had been challenged in lawsuits filed in federal courts across the country, and had been subject to preliminary injunction preventing their enforcement in some, but not all, states and school entities.

With his decision in Tennessee v. Cardona, United States District Judge Danny C. Reeves has now vacated the 2024 Title IX Regulations in their entirety, meaning all provisions of the 2024 Title IX Regulations, both substantive and procedural, are no longer in effect across all states and school entities. Judge Reeves supported his decision by stating that “the [2024 Title IX] regulations exceed the Department’s authority under Title IX, violate the Constitution, and are the result of arbitrary and capricious agency action.”

Importantly, the Tennessee v. Cardona decision relates only to Title IX and has no impact on other federal, state, and local laws, including the Pennsylvania Human Relations Act (PHRA) and its corresponding regulations.

Knox Law will continue to review this important federal decision and the implications it has for our school clients. We will also keep you informed as to any potential appeals and/or guidance from the Department of Education. Until then, school entities should immediately cease use of the 2024 Title IX Regulations and policies adopted to comply with the same and should return to the policies and procedures adopted in compliance with the 2020 Title IX Regulations.

Title IX is a federal law that prohibits sex discrimination in education programs and activities that receive federal funding. It also protects people from sexual harassment and sexual violence.
